These Terms govern your BACKROOM account, free trial and purchases from Elijah Studio, Ariana, Tunisia (“Elijah Studio”, “we”, “us”). Use of the Software itself is also governed by the End User Licence Agreement (EULA). By creating an account, starting a trial or buying a plan you accept these Terms, the EULA, the Refund Policy and the Privacy Policy.

1. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract. Give accurate information and keep your password secure. One account is for one person; you are responsible for everything done with your account. We may refuse or close accounts that break these Terms.

2. Free trial

Every new customer gets one free 3-day trial with full features, starting the first time they sign in on their Mac. No payment details are required. The trial is limited to one per person and one per Mac. We use account and device signals to detect trial abuse; creating extra accounts to get more trials may lead to all related accounts being closed. Use the trial to check the Software works with your Mac, footage and workflow — that is what it is for.

3. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, invoicing and sales tax are handled by Paddle under the Paddle Buyer Terms. The licence to use BACKROOM is granted by Elijah Studio under our EULA.

4. Plans, prices and taxes

Prices are shown at checkout. Applicable taxes are calculated and collected by Paddle based on your location. Any bank, currency-conversion or card fees charged by your own bank are your responsibility.

5. Subscriptions and automatic renewal

Monthly and Yearly plans renew automatically at the end of each period, at the then-current price, until you cancel. By subscribing you authorise Paddle to charge your payment method at each renewal. You can cancel any time from the app (Account › Manage billing) or from your Paddle receipt; cancellation takes effect at the end of the current paid period, you keep access until then, and no refund or credit is given for the unused part of a period. To avoid a renewal charge, cancel before the renewal date.

6. Lifetime

Lifetime is a one-time payment for a perpetual licence to the current major version of BACKROOM (version 4) and all of its updates for as long as we develop that version. Future major versions may be offered separately, usually at a reduced price for Lifetime owners. “Lifetime” refers to the product version, not to any person or device.

7. Price changes

We may change prices. For an existing subscription, a new price applies only from your next renewal after we have given you at least 30 days’ notice by email or in the app. If you do not agree, cancel before that renewal.

8. Instant delivery and your right of withdrawal

Your licence is delivered and activated immediately after payment. At checkout you expressly request immediate access to the Software and acknowledge that, where the law allows, you thereby lose any statutory right of withdrawal (for example the 14-day right for EU and UK consumers) once the licence is delivered. Refunds are only available as described in the Refund Policy.

9. Failed payments

If a renewal payment fails, Paddle may retry it. If it still has not been paid after 7 days, your plan may be suspended until the payment succeeds or you choose a new plan.

10. Chargebacks and payment disputes

If you have a problem with a charge, contact us first at [email protected] — we answer quickly and most issues are solved in a day. Opening a chargeback or payment dispute without first contacting us is a breach of these Terms. While a dispute is open, your licence and account are suspended. We and Paddle will contest disputes we believe are unjustified, using records including your acceptance of these Terms and the EULA (version, time, IP address and browser), your purchase, and your activation and licence-check history. If a dispute is found to be unjustified or fraudulent, the related account may be closed permanently and you remain liable for the amount due, to the extent permitted by law.

11. Fraud and abuse

We may cancel orders, refuse service, and revoke licences obtained with stolen or unauthorised payment methods, by fraud, through refund abuse, or through misuse of promotions or trials.

12. Licence and acceptable use

Your use of the Software is governed by the EULA. In short: one Mac at a time per licence, no sharing of accounts or licences, and no reverse engineering, cracking or circumventing the licensing.

13. Suspension and termination

We may suspend or close an account that breaches these Terms or the EULA. No refund is due for a plan terminated for breach. You can stop using BACKROOM and ask us to delete your account at any time by emailing us; deleting your account does not cancel an active subscription automatically — cancel it first.

14. Availability

We aim to keep the licence service available at all times but do not guarantee it. Planned maintenance and outages do not entitle you to a refund; the 7-day offline period covers short interruptions.

15. Warranty and liability

The warranty disclaimer and limitation of liability in sections 12 and 13 of the EULA also apply to these Terms. Nothing in these Terms affects rights you have as a consumer that cannot be limited by law.

16. Changes

We may update these Terms. Material changes will be announced by email or in the app at least 14 days before they take effect; changes affecting paid plans apply from your next renewal. Continuing to use BACKROOM after that means you accept the updated Terms.

17. Law and disputes

These Terms are governed by the laws of Tunisia, and the courts of Tunis have exclusive jurisdiction, subject to any mandatory consumer protections of your country of residence. You agree to contact us first and try to resolve any dispute in good faith within 30 days.
